Welcome to Mixed Media Creations. By accessing this website, galleries, digital content, or services provided by Tandem Axle Inc. dba Mixed Media Creations (“MMC,” “we,” “our,” or “us”), you agree to the following Terms of Use.

1. Intellectual Property

All photography, videography, branding, graphic design, logos, marketing materials, website content, copywriting, digital assets, AI-assisted creative outputs, and creative strategy produced by MMC are protected by copyright and intellectual property laws. Unless otherwise agreed to in writing, all creative work remains the property of Mixed Media Creations.

2. Limited License

Clients and visitors may view content for personal or approved business reference, share publicly published MMC content with proper credit, and download approved deliverables specifically provided for use. Users may not reproduce, resell, redistribute, sublicense, modify, or commercially exploit MMC content without written authorization.

3. Photography, Video & Media Usage

All delivered media is subject to the licensing and usage rights outlined in the applicable proposal, estimate, agreement, invoice, print release, or licensing agreement. RAW files, source files, project files, and unedited footage are not included unless specifically licensed in writing.

4. Portfolio & Promotional Rights

Unless otherwise restricted in writing, MMC reserves the right to display completed work in portfolios, presentations, social media, marketing materials, case studies, industry awards submissions, educational materials, and promotional campaigns.

5. Client Responsibilities

Clients are responsible for securing all necessary permissions, licenses, approvals, releases, trademarks, music rights, talent permissions, and property access related to project content supplied to MMC. Clients also agree to review deliverables promptly and maintain backups of delivered assets after final delivery.

6. Accessibility Commitment

MMC strives to support accessibility and inclusive design best practices, including WCAG and ADA-conscious workflows where applicable. However, MMC cannot guarantee accessibility compliance for third-party platforms, plugins, client modifications, hosting environments, integrations, or software outside MMC’s direct control.

7. AI & Automation

MMC may utilize AI-assisted tools, automation platforms, transcription systems, editing technologies, and third-party software as part of creative, operational, accessibility, marketing, and production workflows.

Clients acknowledge that evolving technologies may be incorporated into project delivery.

8. Third-Party Platforms

This website and related services may integrate with third-party providers including Pic-Time, Vimeo, Google, Meta/Facebook/Instagram, Stripe, PayPal, YouTube, Adobe, Canva, hosting providers, analytics providers, and other software or cloud-based services. MMC is not responsible for outages, data loss, policy changes, platform limitations, or security failures originating from third-party providers.

9. Payments & Refunds

Deposits, retainers, milestone payments, subscriptions, and invoices are governed by the applicable proposal, estimate, agreement, or invoice terms. Creative work already completed, production costs incurred, third-party expenses, licensing fees, travel expenses, and approved purchases are generally non-refundable.

10. Indemnification

Clients agree to indemnify and hold harmless MMC, its employees, contractors, and affiliates from claims, damages, liabilities, legal fees, or expenses arising from materials, content, trademarks, music, images, or information supplied by the client or used at the client’s direction.

11. Limitation of Liability

To the fullest extent permitted by law, MMC shall not be liable for indirect, incidental, consequential, punitive, or special damages, including lost profits, business interruption, reputational damage, platform outages, data loss, cyber incidents, or unauthorized third-party access. MMC’s total liability shall not exceed the amount paid for the specific project or service giving rise to the claim.

12. Force Majeure

MMC shall not be held responsible for delays or failure to perform caused by events outside reasonable control, including acts of God, severe weather, internet outages, cyberattacks, labor shortages, illness, pandemics, vendor failures, platform outages, governmental actions, or equipment failures.

13. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of Texas, without regard to conflict of law principles.

14. Dispute Resolution

The parties agree to attempt good-faith resolution of disputes prior to litigation. Venue for any unresolved dispute shall be Denton County, Texas, unless otherwise agreed in writing.

15. Privacy

Please review MMC’s Privacy Policy for information regarding how personal information may be collected, stored, and used.

16. Modifications

MMC reserves the right to update or modify these Terms of Use at any time without prior notice. Continued use of the website or services constitutes acceptance of revised terms.
